1. Purpose and Scope
Timeless Beauty is committed to ensuring that all Commercial Electronic Messages (CEMs) distributed by or on behalf of the company comply with applicable global anti-spam and electronic marketing laws.
This Policy applies to all employees, contractors, affiliates, vendors, agencies, partners, and any third party who sends communications on behalf of Timeless Beauty.
2. Key Definitions
2.1 Commercial Electronic Message (CEM)
A Commercial Electronic Message refers to any electronic communication—email, SMS/text, direct message, in-app notification, or equivalent—sent for the purpose of advertising, promoting, or offering products, services, events, or business opportunities of Timeless Beauty or its affiliates.
2.2 Consent
Consent means a verifiable indication that a recipient agrees to receive CEMs from Timeless Beauty. Consent may be:
-
Express Consent (Required for All CEMs):
A clear affirmative action (e.g., checking an unchecked box, submitting an opt-in form, confirming via double opt-in email). Silence, inactivity, or pre-checked boxes do not constitute consent. -
Withdrawal of Consent:
A recipient may revoke consent at any time via an Unsubscribe Request.
2.3 Unsubscribe Request
An Unsubscribe Request is any direct or indirect communication indicating that a recipient no longer wishes to receive CEMs. Requests may be sent through an unsubscribe link, reply email, customer service submission, or any other clear method.
3. Consent Requirements
-
Timeless Beauty requires express opt-in consent before sending any CEM.
-
Opt-in mechanisms must:
-
Clearly state the purpose for which communications will be sent.
-
Link or refer to this Anti-Spam Policy.
-
Require an affirmative action (no pre-ticked boxes).
-
-
Double opt-in is strongly encouraged and may be required in higher-risk jurisdictions.
-
Consent must be documented, timestamped, and stored securely.
4. Unsubscribe Requirements
-
All CEMs must contain a clear, visible, no-cost unsubscribe mechanism.
-
Unsubscribe Requests must be:
-
Processed within five (5) business days of receipt.
-
Added to a permanent suppression list that prevents any future CEMs unless the individual provides new express consent.
-
-
Recipients must not be required to log in, provide additional information, or complete multiple steps to unsubscribe.
-
Suppression logs must be maintained indefinitely.
5. Header, Subject Line, and Routing Requirements
All CEMs sent by or on behalf of Timeless Beauty must:
-
Use accurate and non-misleading “From,” “Reply-To,” domain, and email addresses.
-
Include a truthful and relevant Subject line that accurately reflects the content of the message.
-
Not disguise or obscure the sender’s identity, routing information, or origin server.
-
Clearly identify the message as an advertisement or promotion where legally required.
6. Required Disclosures
Each CEM must include:
-
The legal name of the sender (Timeless Beauty).
-
The physical mailing address (United Kingdom).
-
A functioning return email address (support@timelessbeautyantiaging.com).
-
Any other disclosures required by applicable jurisdictional law.
7. Prohibited Conduct
The following are strictly prohibited:
-
Sending CEMs to recipients without express opt-in consent.
-
Using deceptive or falsified headers, sender names, subject lines, or IP addresses.
-
Harvesting email addresses, scraping data, or using purchased lists without verified opt-in.
-
Sending messages via automated systems without proof of consent.
-
Ignoring or delaying unsubscribe actions.
-
Sending messages through anonymous or misleading routing practices.
8. Record-Keeping and Audit Trail Requirements
Timeless Beauty shall maintain:
-
Records of express consent (date, time, method, IP address, and source).
-
Logs of all CEMs sent, including content, send date, and mailing list source.
-
Comprehensive suppression list records.
-
Verification logs for third-party vendor compliance.
-
Periodic audit reports confirming compliance with this Policy.
Records must be retained for at least three (3) years or longer where required by law.
9. Third-Party and Affiliate Responsibility & Liability Disclaimer
-
Any third party sending CEMs on behalf of Timeless Beauty must comply with this Policy and all applicable anti-spam laws.
-
Timeless Beauty shall not be liable for violations committed by independent third parties, affiliates, or partners.
-
Timeless Beauty reserves the right to terminate relationships with any party that engages in non-compliant practices.
-
All third parties must maintain their own consent records and provide them upon request.
10. Monitoring, Enforcement, and Penalties
-
Timeless Beauty conducts periodic internal and external audits.
-
Employees or partners found to violate this Policy may face disciplinary action, including contract termination.
